Question:

Once PERM comes out, will the employers continue to have a choice of filing non-RIR applications?

Answer by Gary Endelman:

If PERM is published as proposed, PERM will be the mandatory and exclusive way of filing labor certs after a couple of months transition period.

Answer by Joel Stewart:

It appears that PERM would replace both regular and RIR processing with PERM. If that is the case, then there would be no choice of processing, just PERM! We have to wait for the final regulations of course.
