REAL ID May Not Be All Bad

The foreboding by many of the anti-immigration REAL ID bill may be unwarranted. Rep. Sensenbrenner's insistence that immigration be given top billing in the 109th Congress will likely provide the opportunity for Senators Craig and McCain to insist on guestworker and legalization reform at the same time. Thus, the final act will likely include both enforcement and benefits. Thanks to Rep. Sensenbrenner's unwitting aid, the mood is ripe for fundamental immigration reform. While relief on the benefits side is welcome news for the long suffering immigration law community, the price paid thanks to the ill-advised efforts of Rep. Sensenbrenner will be that our country will be saddled with a National ID card. So, REAL ID is bad policy but not necessarily bad immigration policy since its enactment would virtually assure a conjoined enactment of serious benefit relief.
