I just wanted to alert Immigration Daily readers that Judge Brinkema of the District Court of the Eastern District of Virginia granted yesterday our immigration habeas petition in which she agreed that the BIA has misinterpreted section 236(c) of the INA, and ruled that mandatory detention does not apply to our client who was detained by ICE well over 1 month after being released from state custody (see Waffi v. Loiselle, et al., USDC for the Eastern District of VA, Alexandria Division, l:07cv742(LMB/BRP)).
