Vigilantes In Uniform

According to a Washington Times news story, "President Bush's spokesman yesterday said the case of two US Border Patrol agents who are seeking a pardon for having shot a fleeing suspected drug dealer has been mischaracterized and the agents violated regulations" (for the full story, see here).

This incident raises the question, "Is the border a war zone?" Only then, can shooting an unarmed fleeing suspect be justified since the rules of engagement in a combat zone are more permissive for the use of deadly force. Yes, the border is in chaos and we are far from securing our borders. However, the border is not a war zone. The actions of these two Border Patrol agents were found by a jury to be criminal, and as such, they should complete their sentences. Doing so will not only serve the ends of justice but will send a strong message that the rule of the law applies on the border.

Supremes Say Attempted US Reentry Indictment Is Not Defective
In US v. Resendiz-Ponce, No. 05-998 (Sup. Ct. Jan. 9, 2007), the court said that "not only does "attempt" as used in commonparlance connote action rather than mere intent, but, more importantly, as used in the law for centuries, it encompasses both the overtact and intent elements. Thus, an indictment alleging attempted re-entry under 1326(a) need not specifically allege a particular overt act or any other "component par[t]" of the offense." Justice Scalia dissented.

Dear Editor:
What next (see 01/16/07 ID comment). Some immigration attorneys in downtown Austin decided to boycott Starbucks to "stand by " the poor undocumented Mexicans ( just because their wives and staff are from downtown Mexico) I wonder if they are going to march and hold banners to protect the "pizzas for pesos", and I also wonder if they're going to accept pesos for their excellent representation ( so they think) in front of the Service and the EOIR. I am just wondering.
