PERM Approvals

Immigration Daily has learned that the first wave of denial letters and audit letters has already been received and that the first approval letters are expected to be in the mail in the next week or two. This is both bad and good news. The good news is that there are some PERM approvals. The bad news is PERM not only necessitates a steep learning curve but also ensures that cases will be very complex making legal counsel for PERM more expensive, thus reducing the size of the labor certification market as attorneys raise their fees for PERM cases.

Jurisdiction Exists Where No Determination Made On Extraordinary Circumstances Exception In Asylum Claim
In Sagaydak v. Gonzales, No. 02-74299 (9th Cir. May 4, 2005), the court said that when a Petitioner alleges that his failure to file a timely aslyum application was due to extraordinary circumstances andn both the IJ and the BIA failed to determine whether the extraordinary-circumstances exception should apply, it had jurisdiction to review the failure to make a determination. The court also said that in this case the Petitioners refusal to accede to bribery in the context of the politics of the country he was in was a political statement.
