Immigration Swamps Circuit Courts
Circuit courts are sinking under the weight of immigration appeals. The BIA's affirmance without opinion procedure has resulted in a fast clearing of the BIA's backlog. Without commenting on the quality of the BIA's review, one fact is clear: more immigration cases are headed for the Circuit courts. Circuit courts are accustomed to a well-developed record and typically receive a case that has been fully developed in agency proceedings including agency appellate review, followed by a district court record and decision. The bulk of the immigration cases they now receive have merely the IJ's proceedings record, with no BIA or district court addition to the record and consequent filtering of the issues. We doubt if reviewing raw transcripts of immigration court proceedings is the best use of the Circuit courts' time. In the 9th Circuit, in particular, immigration cases account for almost half of the Circuit court's docket and the 2nd Circuit is not too far behind. This sorry state of affairs affects the administration of justice for all matters before the Circuits not merely immigration matters. The federal Circuit courts are under siege. Congress should fashion an appropriate solution and bring relief to the Circuit courts before things get much worse.

9th Circuit Amends Disbarment Order
In Gadda v. Ashcroft, No. 02-15113 (9th Cir. filed Apr. 1, 2004, amended Jul. 20, 2004), the court issued an amended order which said that the clients of the attorney Respondent who was ordered to file notices of withdrawal would be informed that they could either obtain new counsel or notify the court that they wished to proceed pro se or request that the court appoint counsel for them. The court on its own motion recalled the mandate of its original April 1, 2004 order disbarring the attorney from the practice of law before the 9th Circuit, and issued the mandate on July 20, 2004.

I am appalled by the prejudiced sentiments expressed in Mr. Krikorian's opinion piece on the folly of the visa lottery. The lottery is bad because it's bringing in brown and black people, who are apparently not only corrupt but also likely to be terrorists due to their religion. It is bad because it isn't promoting the immigration of white people. Certainly sounds like 'gratuitous profiling' to me, despite the author's two paltry examples to the contrary.
I like the lottery because it offers a chance to people without relatives here to help them, who don't already have a foot in the door here. If I were going to change it, I would require proficiency in English and a more advanced set of skills or education. Certainly, the new immigrants should be those who can hit the ground running. I think that there are plenty of Bangladeshis, Nigerians, Egyptians and others who would make great contributors to our society if they won the diversity lottery. This opportunity should remain available.
