BIA Cannot Recharacterize Motion To Reopen As Motion To Reconsider Under Iturribarria
In Singh v. Ashcroft, No. 02-72759 (9th Cir. May 18, 2004), the court said that the BIA abused its discretion in refusing to toll the filing deadline for Petitioner's ineffective assistance of counsel claim, and erred as a matter of law when it recharacterized Petitioner's motion to reopen as a motion for reconsideration.
