Filing False Tax Return Is Not Aggravated Felony
In Lee v. Ashcroft, No. 02-4602 (3rd Cir. May 19, 2004), the court said that a conviction for filing a false tax return in violation of 26 USC 7206(1) of the Internal Revenue Code was not an "aggravated felony" under section 101(a)(43)(M)(i) of the INA. The court also said that in enacting subsection 101(a)(43)(M)(ii) of the INA, Congress intended to specify tax evasion as the only deportable tax offense.
