Felony Conviction Defeats Nationality Claim By Demonstrating Lack Of Allegiance
In Shittu v. Elwood, No. 02-0682 (District Court for the Eastern District of Pennsylvania, May, 2002), the court held that Petitioner, who was a permanent resident and who claimed that he could not be deported as an aggravated felon alien while his application for naturalization was pending since he claimed to be a "national" of the United States, was not entitled to habeas relief since his felony conviction objectively demonstrated his lack of allegiance to the United States and this was sufficient by itself to refute any evidence of his permanent allegiance to the US.
Beneficiaries Under Child Citizenship Act Must Have Been Under 18 As Of Date Of Enactment
In Jezuit v. Perryman, No. 01-C-1141 (District Court for the Northern District of Illinois May 14, 2002), the court held that the section of the Child Citizenship Act conferring citizenship on certain minor children of US citizens applies only to individuals who were under eighteen years of age on or after February 27,2001, the date of enactment.
INS Says LIFE Act Adjustment Deadline Will Be In 2003
INS issued a news release announcing the issuance a final rule for adjustment of status application procedures under the LIFE Act. The filing deadline yet to be announced will be in 2003.
EEOC Q&A On Discrimination Against Employees
The Equal Employment Opportunity Commission released a "questions and answers" sheet about the workplace rights of Muslims, Arabs, South Asians and Sikhs under the Equal Employment Opportunity Laws. The Department of Justice Office of Special Counsel for Immigration Related Unfair Employment Practices enforces the prohibition on national origin discrimination as it relates to hiring and discharge against employers with four to fourteen employees.
