Editor's Comments of the Day

With the start of the new year ILW.COM would like to thank our readers and visitors to the site over the past year. Since our first issue on May 2, 2000, the number of subscribers to the e-mail version has reached almost 5,000 and continues to grow. We have reviewed the statistics to see which pages were the most popular in the year 2000. The top five most viewed pages from Immigration Daily were: (insert drum roll)

1) The Summary of the H-1B Bill,
2) The 1998 Statistical Yearbook of the INS,
3) H-1B Visa Numbers and Immigrant Visa Allocation by Cyrus Mehta,
4) The 10 Implications of the New H-1B Quota Increase by Xavier Augustin,
5) The INS announcement about the signing of the H-1B bill and fee increase.

We also looked at which features visitors to the site use most often. After the home page, the most visited is Immigration Daily. The next most popular page is chat with lawyers. The page with employment based immigration information was the next most popular. Rounding out the top five at the end of the year is the chat transcripts page.

Refusal to Waive Filing Deadline not Abuse of Discretion
In Huicochea-Gomez v. INS, No. 99-4119 (6th Cir. Jan 2, 2001), the court found that Petitioner could not establish a claim of ineffective assistance of counsel where he could not have prevailed on the facts, and the Board of Immigration Appeals ("BIA") did not abuse its discretion when it denied a request for additional time to submit a brief where no copy of the request was served on opposing counsel.

Policy to Protect Jailed Immigrants Is Adopted by U.S.
According to the New York Times [registration required] even though the INS has issued national standards for the treatment of its detainees in county jails and detention centers, critics argue that conditions may not improve because the guidelines do not have the weight of law and could prove impossible to enforce.

Phones Key to Theft of Birth Certificates
The South Florida Sun-Sentinel reports that an armed man stole more than 700 blank birth certificates from the county Office of Vital Statistics. Officials fear that these documents could be used to create or steal identities, acquire credit cards, forge passports or gain US citizenship illegally.
