March Information on 245(i)
by Arthur L. Zabenko and Nina Manchanda

In our end-of-the-month tradition of gathering articles and information about section 245(i) that have appeared in Immigration Daily , here are the features on 245(i) for the month of March:

In early March Carl Shusterman held a special chat on 245(i), for ILW.COM site users.

In the article "The Nuts and Bolts of 245(i)" Brian D. Lerner answers questions about how section 245(i) works and who can benefit from it. Curtis Pierce explains 245(i) in plain terms with easy to understand examples in his article "245(i) for Dummies". In "RIRs and 245(i) - Some Special Considerations" Sam Udani offers five reasons to file regular and not RIR labor certification cases in the days leading up to the April 30, 2001, deadline for 245(i), and Nina Manchanda offers a compendium of recent articles on 245(i) providing a variety of approaches and viewpoints in "Finding Information on 245(i)" .

During March the INS issued an INS Office of Business Liaison Employer Information Bulletin 25 ,an updated memo on 245(i) which contains information on adjustment of status, the history of section 245(i), the confusion of the LIFE Act with amnesty, and what and how to file to take advantage of section 245(i). The INS later announced that it would implement the section 245(i) provision of the LIFE Act and an interim rule for adjustment-of-status application procedures under Section 245(i) would be published in the Federal Register. (El INS Aplica la Disposición de la Ley LIFE Relativa a la Sección 245 versión espanol). The INS also provided a sheet of Q & A on section 245(i),. (Disposiciones de la Ley LIFE Relativas a la Seccion 245 versión espanol).

And, at the end of the month the Federal Register published an interim rule issued by the DOJ amending its regulations governing eligibility for adjustment of status under section 245(i) in order to conform the regulations to existing policy and procedures and to remove language that has been superseded by subsequent legislation.

As the interest in 245(i) intensifies, ILW.COM will continue to bring you articles, government information, INS press releases and special chats on the temporary restoration of section 245(i).
